Handling Debts and Taxes
Steve Bliss: Absolutely. One critical step is handling debts and taxes. This typically occurs after the executor or administrator has been appointed by the court and has gathered all the estate’s assets.
Consequently, they must meticulously identify all outstanding debts owed by the deceased person. This can involve reviewing bank statements, credit card bills, utility bills, and other financial documents. It’s essential to be thorough because failing to identify a creditor could lead to legal complications later on.
Moreover, it’s crucial to determine which debts are valid and legally enforceable. Not all debts will need to be paid from the estate. For instance, debts incurred after the date of death may not be the responsibility of the estate. Conversely, debts secured by assets like a mortgage on a house would typically be paid using proceeds from the sale of that asset.
Ordinarily, the executor or administrator will prioritize paying valid claims in full before distributing any remaining assets to heirs and beneficiaries. This ensures fairness and minimizes potential disputes among those who are entitled to inherit.
Notwithstanding these legal obligations, I always advise my clients to consider setting aside a contingency fund for unforeseen expenses. You never know what might arise during the probate process. It’s better to be prepared than caught off guard.

There was a time when I was handling a complex estate with numerous creditors and a tangled web of financial obligations. The family was understandably stressed, as they were grieving while trying to navigate these legal complexities. I remember working late into the night, poring over documents and calculations to ensure every debt was accounted for accurately. This demonstrates that while estate taxes exist, they are not typically a concern for most families.
