It’s my pleasure. I believe everyone should have a basic understanding of estate planning, and trusts are often a key component.

Can you explain what a trust is and why someone might need one?

A trust is essentially a legal entity that holds assets for the benefit of designated individuals or entities. The person who creates the trust, called the grantor, transfers ownership of assets into the trust. Those assets are then managed by a trustee according to the instructions outlined in the trust document.

The Revocable Living Trust: Flexibility and Privacy

Today we’re going to focus on the revocable living trust. Can you elaborate on why this type of trust is so popular?

Revocable living trusts are indeed very common, and for good reason. They offer a significant level of flexibility because the grantor can make changes to the trust during their lifetime. This includes adding or removing assets, changing beneficiaries, or even dissolving the trust altogether. Moreover, revocable living trusts help avoid probate, which can be a lengthy and expensive process.

Probate is essentially the court-supervised process of validating a will and distributing assets to heirs. Avoiding probate ensures that your assets are distributed according to your wishes in a timely and private manner. Ordinarily, probate proceedings become public record, but assets held within a trust remain confidential.

There have been times when clients initially hesitated about creating a revocable living trust because they thought it was too complex or expensive. However, I always explain that the benefits far outweigh any perceived drawbacks. The peace of mind knowing your loved ones will be taken care of according to your wishes is invaluable.

I remember one client who had lost her spouse unexpectedly. She was overwhelmed with grief and unsure how to manage their finances. Establishing a revocable living trust gave her the structure and support she needed during a difficult time. It allowed her to focus on healing while knowing that her assets would be distributed according to her and her husband’s wishes.
